第十条 国徽及其图案不得用于：

（一）商标、广告；
（二）日常生活的陈设布置；
（三）私人庆吊活动；
（四）国务院办公厅规定不得使用国徽及其图案的其他场合。

第十三条 在公众场合故意以焚烧、毁损、涂划、玷污、践踏等方式侮辱中华人民共和国国徽的，依法追究刑事责任；情节较轻的，参照治安管理处罚条例的处罚规定，由公安机关处以十五日以下拘留。

Artigo 10.º É proibido o uso do Emblema Nacional e do seu desenho em:

1. Marca ou publicidade;

2. Mobiliário ou artigo de decoração de uso corrente;

3. Celebração ou cerimónia fúnebre privadas; e

4. Outras situações previstas pela Secretaria-Geral do Conselho de Estado.

Artigo 13.º Quem, pública e intencionalmente, queimando, danificando, pintando, sujando ou pisando, ultrajar o Emblema Nacional da República Popular da China, será responsabilizado nos termos da lei penal. Quando se tratar de uma infracção de menor gravidade, o infractor será detido por período não superior a quinze dias pelo órgão de segurança pública, conforme as disposições da legislação relativa às sanções no âmbito da administração da segurança pública.
